This paper considerate as a general objective of the reflection of the migration policies implemented in Brazil in the period from 2010 to 2022 and their influence on the promotion and protection of the human and fundamental rights of individuals who chose the country as their destination. However, it does not ignore the historical path, the challenges and possible gaps that may exist in public migration policies in the country.
To achieve this purpose, secondary objectives were outlined. Firstly, the theme of migration will be addressed, exploring its various characteristics and implications. Next, a critical analysis of the Brazilian legislation that governs migration processes will be carried out, with special emphasis on the replacement of the Foreigner Statute by Law No. 13,445/2017. Finally, a reflection will be promoted on the role of the Brazilian State in the face of migratory flows involving Haitians and Venezuelans in the period in question, including the emergency measures adopted to welcome these populations. At this point, statistical issues will be addressed, based on pre-existing studies and official data made available by the Brazilian State.
This study aims to contribute to an in-depth understanding of migration policies in Brazil and their impact on the fundamental and human rights of migrants. By addressing migration policies in Brazil between 2010 and 2022, with emphasis on legislative changes, we hope to obtain an in-depth understanding of the transformations in the country's migration scenario. The analysis of changes in the relevant legislation will allow us to identify the main legal frameworks that impacted the entry, stay and exit of foreigners in Brazil during this period, in addition to allowing the practical effects of these changes on the lives of migrants, as well as on promotion and protection, to be elucidated. of their fundamental and human rights. Therefore, we seek to understand how such policies influenced migratory flows, including issues such as the regularization of immigrants, the reception of refugees and the integration of these populations into Brazilian society. In the end, we intend to provide a comprehensive and grounded analysis of migration policies in Brazil.
